Requirements and forms

 

Submission of the Pre-application is done individually, to satisfy the following requirements, depending on whether the property is registered to or in the possession of the applicant.

Properties that are registered in the Public Real Estate Registry

Written Pre-application to access the PSA Program, presented to the appropriate Regional Office (use the PSA Pre-application form).

 

Include the following information: complete name of owner and/or co-owners; legal characteristics such as complete civil status, identification card numbers of owners, profession or occupation, and domicile of all co-owners.

Indicate also if you have a special power of attorney, and if payment will be made directly to FONAFIFO or through an intermediate organization.

 

Include the PSA method to be used (Protection, Reforestation and/or SAF), the area or number of trees to submit, registry data of the property (real estate registry number(s), and number(s) of certified survey plan(s)), administrative location of the property (province-canton-district), and contact information of the applicant(s) to receive notifications (preferably telephone, fax and/or electronic mail).

 

Indicate if you have any obligations with the I.D.A., or any debt with state or private banks.

 

In cases of corporations, please also indicate the legal representative(s): complete name(s), complete civil status, identification number(s), profession or occupation, and domicile(s) of all legal representatives.

 

A visible photocopy of the valid physical identification card of the owner and/or co-owner(s), or otherwise, a visible photocopy of the corporate identification card, and of the legal representative(s).

 

Copy of both sides of the certified survey plan.

 

For each PSA method applied for, either Protection and/or Reforestation, or SAF, you must submit a separate application.

Pre-application in writing submitted to the appropriate Regional Office to participate in the PSA (use the PSA Pre-application form)

 

This form must be completed with the following information: complete name of the owner and/or co-owner(s); legal characteristics such as: complete civil status, identification number of owner(s), profession or occupation, and domicile(s) of all co-owner(s).

 

Also, please indicate if you have a special power of attorney, and if payment will be made directly to FONAFIFO or through an intermediate organization.

 

In cases of corporations, please also indicate for the legal representative(s): complete name(s), complete civil status, identification number(s), profession or occupation, and domicile(s) of all legal representatives.

 

Indicate if you have obligations with the I.D.A., or any debt with state or private banks.

 

Under these conditions, you may only apply for the method PSA-Protection, indicating the area to be covered, registration data of the property (number(s) of certified survey plan(s)), administrative location of the property (province, canton, district), and contact information to receive notifications (preferably telephone, fax and/or electronic mail).

 

A legible photocopy of the physical identification card in effect of the owner and/or co-owner(s), or otherwise, legible photocopy of the corporate identification card, and of the legal representative(s).

 

A copy of both sides of the certified survey plan(s).

 

Certified survey plan of the property in the applicant’s possession, or plan prepared by the Instituto de Desarrollo Agrario (IDA). Without any exception whatsoever, certified survey plans provided must be certified by the MINAET, through the SINAC, which will establish if the property is within protected forest areas or not.

 

A notarized letter of sale with the correct date of acquisition of the property, if the property was so acquired, or if the applicant(s) is/are registered as owners in the IDA census, and are declared as beneficiaries and awardees. If the owner is the original owner and does not have the conveyance documents with the formalities set forth, he/she must submit the sworn statements of three witnesses who document in detail, the origin and activities of the ownership. These statements must be recorded in a public deed. He/she may also present any other document about judicial processes or before public institutions proving clearly the land’s ownership.

 

A sworn statement before a notary public of the applicant owner containing a description of the property’s nature, location by province, canton, and local settlement, indicating the complete names of all current neighbors, number of the certified survey plan, measurements, time of ownership, the way in which the property was acquired, and description of acts of possession.

 

A sworn statement, authenticated by attorneys, by at least three of the property’s neighbors, indicating that they know about the ownership of the adjacent owner, and that they do not have any conflict with or dispute about the said boundary or its landmarks, fences or similar aspects of the property. In cases when the limit is a natural or public road, a statement is not necessary. When the neighbor is a public entity, an official note by the relevant authority will be sufficient, indicating what has been specified in this article. If the boundary is with a protected area, submission of a note issued by the director of the corresponding conservation area will be sufficient.
